About OwnPodAI

OwnPodAI is a mobile application that provides a user interface to interact with open-source AI large language models (LLMs) on your device. OwnPodAI does not create, develop, train, fine-tune, or control any AI models. All AI models available within OwnPodAI are developed, maintained, and licensed by independent third-party vendors and organisations, and are hosted on third-party platforms including Hugging Face.

OwnPodAI serves solely as an interface layer — a tool that enables users to download, manage, and interact with these third-party models locally on their devices. OwnPodAI has no influence over model behaviour, outputs, training data, biases, or capabilities.

Third-Party Models & Licensing

AI models available in OwnPodAI are created by third-party developers and organisations including, but not limited to: Google (Gemma), Microsoft (Phi), Meta (Llama), Mistral AI (Mistral/Ministral), Alibaba Cloud (Qwen), IBM (Granite), PrismML (Bonsai), Liquid AI (LFM), Deep Cogito (Cogito), and others.

Each model is subject to its own licence terms as determined by its vendor:

• Gemma models are subject to the Gemma Terms of Use by Google
• Phi models are licensed under MIT License by Microsoft
• Llama models are subject to the Meta Llama Community License
• Mistral and Qwen models are licensed under Apache 2.0
• Other models are subject to their respective vendor licences

By downloading and using any model through OwnPodAI, you agree to comply with that model's vendor licence terms. OwnPodAI makes no warranties regarding the accuracy, safety, reliability, suitability, or fitness of any model. Model behaviour is entirely determined by the model vendors, not by OwnPodAI.

AI Response Disclaimer

Do not rely on OwnPodAI or any model accessed through it for:

• Medical diagnosis, treatment, or health decisions
• Legal advice, contracts, or regulatory compliance
• Financial, investment, or tax decisions
• Safety-critical applications or emergency situations
• Professional advice of any kind
• Factual verification or academic research without independent confirmation

Always verify important information independently through authentic, authoritative, and professionally qualified sources. OwnPodAI is not responsible for any decisions made or actions taken based on AI-generated content.

User Responsibility

You are solely responsible for all prompts you submit and all content generated through this app. This includes but is not limited to:

• The nature and content of your prompts and queries
• How you use, share, publish, or distribute AI-generated responses
• Ensuring your use complies with all applicable local, national, and international laws and regulations
• Any consequences arising from inappropriate, harmful, defamatory, illegal, or unethical prompts

Inappropriate, harmful, abusive, or illegal use of OwnPodAI is entirely your responsibility. OwnPodAI is not liable for any harm, loss, damage, legal action, or consequence resulting from your prompts or from AI-generated responses. Always ask valid, lawful, and responsible questions.

On-Device Processing & Privacy

OwnPodAI does not collect, transmit, store, analyse, or share any user data, conversations, prompts, responses, personal information, usage analytics, crash reports, or telemetry of any kind. Your conversations remain entirely private on your device.

No data generated through OwnPodAI is used to train, fine-tune, or improve OwnPodAI or any third-party AI model, unless you explicitly and voluntarily choose to share your data through a separate mechanism.

Data Deletion

Deleting the OwnPodAI app from your device will permanently delete all locally stored data, including but not limited to: conversation history, downloaded AI models, app settings, preferences, and any cached data.

No data is retained by OwnPodAI or any third party after app deletion. Since all data is stored exclusively on your device, deletion is immediate and irreversible. OwnPodAI has no ability to recover deleted data.

Web Search & External Connections

Web search and all external network connections (other than model downloads from Hugging Face) are disabled by default in OwnPodAI.

If you choose to enable web search, connect to local Ollama servers, or enable any other external connection, you do so entirely at your own risk. When external connections are enabled:

• Your prompts or data may be transmitted over your local network or the internet
• Third-party servers, search engines, or services may receive and process your queries
• OwnPodAI has no control over how third-party services handle your data

OwnPodAI is not responsible for any data exposure, privacy breach, security incident, or any other consequence resulting from user-enabled external connections.

Limited Liability

OwnPodAI is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the maximum extent permitted by applicable law, OwnPodAI, its developers, owners, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to:

• The use or inability to use OwnPodAI
• Any AI models accessed, downloaded, or used through OwnPodAI
• Any content, information, or responses generated by AI models
• Any errors, inaccuracies, hallucinations, or omissions in AI-generated content
• Any decisions made or actions taken based on AI-generated content
• Loss of data, revenue, profits, or business opportunities
• Device performance issues, hardware damage, or battery degradation

No Endorsement

OwnPodAI does not endorse, verify, validate, fact-check, or take responsibility for any information, advice, opinion, recommendation, or content generated by AI models. All AI output should be treated as unverified, potentially unreliable, and not representative of the views or opinions of OwnPodAI or its developers.

The inclusion of any AI model in OwnPodAI's catalogue does not constitute an endorsement of that model, its vendor, its outputs, or its suitability for any particular purpose.

Age Requirement & Parental Responsibility

If a parent or legal guardian provides access to OwnPodAI to a minor (anyone under 18 years of age), the parent or guardian assumes full and complete responsibility for the minor's use of the app, including:

• All prompts submitted by the minor
• All content generated and accessed by the minor
• Active supervision and monitoring of the minor's usage at all times
• Ensuring the minor does not access inappropriate, harmful, or age-inappropriate content

OwnPodAI is not designed for, marketed to, or intended for use by children or minors. OwnPodAI is not responsible for any content accessed, generated, viewed, or encountered by minors using this app. By allowing a minor to use OwnPodAI, the parent or guardian agrees to these Terms & Conditions on the minor's behalf and accepts all associated liability.

Intellectual Property

AI-generated content produced through OwnPodAI does not belong to OwnPodAI. OwnPodAI makes no claim of ownership, copyright, or intellectual property rights over any content generated by third-party AI models.

You are solely responsible for ensuring that any AI-generated content you use, publish, distribute, or commercialise does not infringe on any third-party copyrights, trademarks, patents, or other intellectual property rights. The legal status of AI-generated content varies by jurisdiction, and it is your responsibility to understand and comply with applicable laws.

The OwnPodAI name, logo, and app design are the intellectual property of OwnPodAI and may not be used without permission.

Device Performance & Hardware

Running AI models locally on your device uses significant computational resources including CPU, GPU (Metal/Neural Engine), system memory (RAM), device storage, and battery power. This may result in:

• Device heating or thermal throttling
• Increased battery drain and reduced battery life
• Temporary performance slowdown of other apps
• Significant storage consumption (models range from 400 MB to 3+ GB each)

OwnPodAI is not responsible for any device heating, battery degradation, performance impact, storage limitations, or any other hardware-related consequences resulting from AI model usage. You acknowledge that on-device AI processing is computationally intensive and use the app with this understanding.

Model Downloads & Storage

Downloading AI models requires an active internet connection and uses your mobile data or WiFi bandwidth. Model files range from approximately 400 MB to over 3 GB each.

OwnPodAI is not responsible for:

• Data charges incurred from model downloads
• Storage space consumed by downloaded models
• Download failures, interruptions, or corruption
• Changes to model availability on Hugging Face or other hosting platforms

Model availability is controlled by third-party vendors and hosting platforms. Models may be updated, modified, deprecated, or removed by their vendors at any time without notice to OwnPodAI or its users. OwnPodAI cannot guarantee the continued availability of any specific model.

Local Server Connection (Ollama)

OwnPodAI supports optional connection to local AI servers (such as Ollama) running on your personal computer or home network. This feature is entirely optional and operates at your own risk.

OwnPodAI is not responsible for:

• The security, stability, or configuration of your local server
• The content, behaviour, or safety of models running on your personal server
• Network security of your home or local network
• Any data transmitted between your device and local server
• Any third-party software (Ollama, Docker, etc.) installed on your computer

You are solely responsible for the security and configuration of your local server environment, including firewall settings, network access controls, and model selection.

Indemnification

You agree to indemnify, defend, and hold harmless OwnPodAI, its developers, owners, officers, directors, employees, contractors, contributors, affiliates, and agents from and against any and all claims, demands, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising from or related to:

• Your use or misuse of OwnPodAI
• Your prompts, inputs, or uploaded content
• Content generated during your use of the app
• Your violation of these Terms & Conditions
• Your violation of any applicable law or regulation
• Your infringement of any third-party rights
• Any claim by a third party related to your use of the app

No Guarantee of Service

OwnPodAI does not guarantee uninterrupted, error-free, or bug-free operation of the app. OwnPodAI does not guarantee the availability, quality, speed, or accuracy of any AI model. Services, features, models, and downloads may be modified, suspended, or discontinued at any time without prior notice.

Models may be updated, removed, or changed by their vendors at any time without notice. OwnPodAI has no obligation to maintain compatibility with any specific model version or vendor platform.

Developer Disclaimer

OwnPodAI, its developers, owners, individual contributors, and all affiliated persons and entities are not responsible for any damages, losses, harm, injury, legal action, or consequences of any kind arising from the use of this app, AI model outputs, third-party model behaviour, or any actions taken based on AI-generated content.

The developers of OwnPodAI provide this app in good faith as a tool for accessing open-source AI models. All responsibility for use and outcomes lies with the user.

Camera & Image Analysis

OwnPodAI supports optional camera and photo library access for image analysis using vision-enabled AI models (such as Gemma 4 and Gemma 3). When using these features:

• All image processing happens entirely on your device — images are never uploaded, transmitted, or stored beyond your device
• AI analysis of images may be inaccurate, may misidentify objects, people, text, or content
• Image analysis should not be relied upon for any critical purpose

OwnPodAI is not responsible for incorrect, misleading, or harmful image analysis results. Do not use image analysis for medical diagnosis, identity verification, legal evidence, surveillance, or any safety-critical application. You are solely responsible for the content of images you submit for analysis.

File Uploads & Personal Content

You are solely responsible for any files, documents, photos, or personal content you share with the app. If you upload files containing personal, sensitive, confidential, proprietary, or legally protected information, you do so entirely at your own risk.

OwnPodAI does not review, filter, scan, or validate uploaded content. While all processing is on-device by default, if you enable web search or external server connections, uploaded content may be transmitted outside your device.

OwnPodAI is not responsible for any data exposure, privacy breach, confidentiality violation, or loss resulting from files you voluntarily upload or share, especially when external connections are enabled by you. Always review files before submitting and avoid sharing sensitive personal information such as passwords, financial details, identity documents, medical records, or proprietary business information.

Future Paid Features

OwnPodAI is currently offered free of charge with no subscription, in-app purchases, or paid features. However, OwnPodAI reserves the right to introduce paid features, premium tiers, subscriptions, or other monetisation in the future.

If paid features are introduced:

• Existing free features available at the time of your download will remain accessible
• New premium features will be clearly identified before purchase
• Any payment processing will be handled through Apple's App Store billing
• Refund policies will follow Apple's App Store policies
• Additional terms specific to paid features will be provided at that time

OwnPodAI will notify users of any significant changes to pricing or feature availability through app updates or in-app notifications.

Acceptable Use Policy

You agree not to use OwnPodAI for any purpose that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. Specifically, you agree not to:

• Generate content that promotes violence, hatred, discrimination, or harm against individuals or groups
• Attempt to generate content that exploits, harms, or endangers minors in any way
• Use AI-generated content for fraud, impersonation, phishing, or deception
• Generate content that infringes on intellectual property rights
• Use the app to produce malware, exploit code, or other harmful software
• Attempt to bypass or circumvent any safety features or content filters
• Use AI-generated content in any manner that violates applicable laws or regulations

While OwnPodAI cannot monitor on-device usage, violation of these guidelines may result in removal of app access through future updates. Responsibility for compliance lies entirely with the user.

Third-Party Platforms & Services

OwnPodAI interacts with or references several third-party platforms and services, including but not limited to: Apple App Store, Hugging Face, Ollama, and various model vendor platforms. OwnPodAI is not affiliated with, endorsed by, or partnered with any of these third-party services unless explicitly stated.

OwnPodAI is not responsible for the availability, policies, terms, pricing, or conduct of any third-party platform or service. Your use of third-party services is governed by their respective terms and policies.

Open-Source Components

OwnPodAI utilises open-source software components, including but not limited to llama.cpp, which is licensed under the MIT License. Full licence attributions for all open-source components used in OwnPodAI are available in the Licences section of the app and at ownpodai.com/licenses.

These open-source components are provided by their respective authors under their own licence terms and without warranty. OwnPodAI does not claim ownership of these components.

Disclaimer of Medical, Legal & Financial Advice

OwnPodAI is not a substitute for professional advice of any kind. AI-generated content is not medical advice, legal counsel, financial guidance, therapeutic support, or professional consultation.

If you are experiencing a medical emergency, contact your local emergency services immediately. If you require legal, financial, or professional advice, consult a qualified and licenced professional in your jurisdiction. OwnPodAI expressly disclaims all liability for any reliance placed on AI-generated content for professional purposes.

Severability

If any provision of these Terms & Conditions is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

Entire Agreement

These Terms & Conditions, together with the Privacy Policy and Licence Attributions, constitute the entire agreement between you and OwnPodAI regarding the use of the app and supersede all prior agreements, understandings, and representations.

Terms Updates

OwnPodAI reserves the right to update, modify, or replace these Terms & Conditions at any time and at its sole discretion. Changes will be reflected by updating the "Last updated" date at the top of this page.

Your continued use of OwnPodAI after any changes to these terms constitutes your acceptance of the revised Terms & Conditions. We encourage you to review these terms periodically. If you do not agree with the updated terms, you should discontinue use of the app and delete it from your device.
